The High Court is to hear the case for a judicial review into the government’s mishandling of the raising of the pension age for 50s women on November 30.

The court granted a two hour hearing today.This means that Michael Mansfield and his team will argue the merits of the case for a judicial review.

The Department for Work and Pensions will oppose any judicial review.  The judge  will decide whether it can go ahead.

The granting of a two hour hearing  is significant in the sense that the court has decided that the merits of both sides of the argument  must be examined thoroughly. Previously the court had thought that 30 minutes was enough to hear the arguments – suggesting that it could be turned down without much debate.

The announcement is a victory for the lawyers arguing the  case and for BackTo 60 in taking such an uncompromising stance. The government has so far refused to budge an inch in recognising the grievances of the 3.8 million women who have lost out – some of them living in dire poverty as a result.

The case will be backed up by the paper from Jackie Jones, a law professor at the University of the West England She has produced the report,  which shows that this group of women have suffered discrimination contrary to an international  convention signed by successive UK governments. It is not a legal document but it is an expert opinion.

        At least something is being done, unlike WASPI’s campaign relying on MP’s and APPG which is going nowhere and ending up with crumbs,
        This government don’t want to know and getting the media to ignore the 1950’s ladies plight

    • Yes, thank you Joanne Welch, David Hencke, Jackie Jones, Michael Mansfield and teams! Your efforts at all times have been amazing in fighting for 1950’s women’s stolen pensions. Marvellous idea to have a plan for us all to donate whatever we could to huge legal fees. If we all give a £1 each, it would cover enough legal fees to see this travesty through! With many other groups, donations have been used to buy banners, publicity and marches. We can only otherwise comment on Facebook or Twitter, which gets us nowhere, just support for each other. With the Back to 60 Crowdfunder, it gives us all the opportunity to push through the courts this severe injustice with little cost to each of us. So glad that’s what’s happening now.       • I totally agree and have said this when the first request was made for Legal fees if every 1950′ s woman donated just £1 and unions this would go forward – as it has done with the fantastic Legal team JUSTICE FOR THE INJUSTICE for the 1950’s women.

  1. Great news, laws have been broken & women given too little time to adjust their circumstances. To add insult to injury, the goalpost was moved twice, with no consultation or consideration. We paid in for forty years on the condition that we would receive our state pension at 60. My husband died the year that the date was changed for a 2nd time, aged 60 years & 12 days. He didn’t even reach his pension age & I was unaware of the 2nd change if date because of what I was going through. How arrogant to assume that we are all living longer & cam manage a further four & a half years in my case through no fault of our own, rather the bankers who failed us.

    • My husband died aged 54! all so wrong, six years added! no bus pass, our generation that worked at 15 paid in, we did hard jobs, lifting, standing, long hours and we are expected to carry on working?

  2. I pray that their eyes are opened for us.
    I have £164.00/month only as I’m not 65 till January 2019 then I have to wait until May 2019 for my state pension.
    I lost my job with Department for work and pensions through time off due to Ill health.
    I then looked after my elderly mother and mother-in-law till they passed away. My husband retired at the end of last year aged 68 and have been looking after him through type 1 diabetes problems also bad eyesight.
    We do not get any financial help or reduced council tax etc.
    I am just one of thousands. We are just asking for what we paid into since leaving school at 15 years old and going into work.

      • As a 1953 baby, I did qualify for mine last year at 64, but it is paid 4 weeks in arrears. Luckily I have a small teacher’s pension – trained as a mature, so no big pot for me, but it paid off the mortgage and we manage OK. Husband only 63 so he doesn’t get his for another few years, yet forced to retire on health grounds but without financial support as they say he could sit at a till in Asda, yet has cancer, heart and other problems! My sister dies at 54 of cancer and my brother two weeks ago at 60, Neither will get their pension, nor their families, so what happens to all those contributions? Even if ‘we’ win against the government, they won’t back date anything for the likes of me, but at least I have mine now, all £500 a month less tax as contracted out, another thing I had never explained. Good luck to everyone, keep strong and pray for whatever you can get.

  5. Thankyou very much. I get my pension in 3 weeks time at the age of 64 years plus 363 days. I’ve really struggled and suffered health wise these last year’s. Let’s hope we win this so that other women dont have to suffer like i have .

      • Im same as you Hazel worked since i left school I’m 64 now and won’t get my pension till 66 another 2years i think this is disgraceful the way this Government are treating people they talk about equality there’s nothing equal about this was supposed to be 65 for woman the same as men when i check when i get my pension another 1yr has been added how is that equal rant over x

      • I’m the same, 64 now, having to continue in full time employment after working from aged 15. This money is our right not a benefit and I’m being forced to work now. My husband died at 51 and he or myself didn’t benefit from all he paid in either as they also took that from widows left behind. It stinks.

    Worked full time all my life. Another 3 years to go. Convinced I won’t make it.
    Been robbed of my right to retire at 60 year old.
    I so hope they see sense and pay me and the thousands of women who were robbed, their rightful pension.

  7. It’s too late now for some people especially my mum who passed away three years ago today aged 65 when she retired in June 2015 unfortunately she didn’t get much time to enjoy retirement

Utterly disgusting the way us 50s women have been treated and as for informing us I never received any letter stating they were shifting the goal post first to 65 yrs then 66yrs robbed we were, it should have been brought in at a slower pace instead it was thrust upon us I was born Oct 54 which I think was the hardest hit

    • I was born in March 1955. This seems to be about as bad as it gets in terms of waiting for my state pension. My contributions more than cover my right to retire much earlier than that date – so why do I have to wait until I am nearly 67 to get my state pension? Why is the delay not exactly linear and proportional? Someone born 2 years before me does not have to wait as long as I will. It seems very strange.

      • Julia if you were born in 1955 then you will get your state pension at 66. Only those born 1960 onwards will have pension ages greater than 66.

    • I was born April 1954, I have to wait till I’m 65 years and 7 months. All my life I have fought being discriminated against. I was the first female buyer in my industry but paid a lot less than my male colleagues at the same level. I was actually told by company directors ‘although I was better’, I had a husband who was the breadwinner in my home, as were my male counterparts so I just had to suck it up. Then to be further discriminated against, by not getting my pension, with no warning and told I was the one who wanted to be equal, but I never was, I never got so called equality so how dare they steal my pension in the name of equality.

    • I’m 65 on 8th July 1954. Don’t receive my state pension until 6th May 2020. It just doesn’t make sense. That’s 4 months difference in age but 8 months difference in pensions.

I really hope and pray some good will come from this , I’m 62 have chronic heart disease and arthritis, I was finished from work 2years ago and have been living off a small private pension that’s nearly run out , I don’t get no help from anywhere because I was told I couldn’t make any claims , being able to claim the pension I’ve paid into since the age of 15 , would put me and many more woman like me at ease , so please god let’s hope the get somewhere

  16. Thank you so much! I’m 61 years old and suffered a heart attack on my way to work in June this year. After returning to work 5 weeks later.. against doctors orders, but couldnt survive on statutory sick pay – I lost my job after just 2 weeks! I have now had to claim Universal Credit as I am single and live alone. Not had any income since August! Waiting for my first payment and applying for jobs, with no luck! Not feeling very confident that I shall soon be employed again, and the stress is obviously no good for me right now. Depressed and angry. Thank you again

Thank you David for all that you have done for the 1950s woman, I am one of the worst affected born August 1954.having the goal posts moved twice without been informed, medically retired at 61 with no money ESA or other benefits having to survive on husbands military pension, now selling our home so we can survive till I’m 65 years 12 months and 7 days not that I’m counting.

  20. They changed the goalpost twice . The second time I missed out by 3 days so instead of retiring at 60 I officially retire March 2019 when I will be 65 years and 3 months . I am so tired I won’t be able to enjoy my retirement. So what will happen to the 5 years and 3 months I have had to work over since I turned 60. I have worked since I was 12 on a milk round before I went to school . I have worked fulll time since I was 15 and paid my NI stamp since then .

  21. By the time I receive my government pension, I will have worked over 50years, mostly full time and part time for a few years while raising children. Not only have women of our generation paid in over 5 years extra stamp but also not been paid our rightful pension. Very unfair on both counts. Many thanks to David Hencke.

  22. Difficult to express my gratitude to you David. Never did I realise after giving my working life as NHS nurse would I now be nearly 63 with worsening asthma, haemorrhages both eyes and wondering how on earth I can do another three years. Paid NI 47 years and ZERO notice, treated appallingly.

  23. Born Dec 54, left work after a nervous breakdown thinking I could claim my pension at 60…. how wrong was I! Rented out my home and have been living in a campervan.Thank goodness I am in good health. Not how I expected to spend my years in the winter of my life! Thank you, David, for all your help with this travesty of justice. Shame on the parliamentarians who will retire on a very good pension whilst leaving their minions, honest citizens who voted for them, to rot. Beware -winter is coming!

The Parlaimentarians will no doubt not be working until they’re 66, they will be receiving their handsome pensions alongside their state pensions, no doubt. And they’ll all have very healthy bank balances to boot! Why would they be concerned about the 50’s women although my appreciation does go to the MP’s who have given their support. I was born 25th July 1955 and will have to wait until my 66th birthday for my state pension, I also started work just before my 15th birthday, I took a few years off full time work to raise my 2 children in their early years, whilst working part time, sometimes 2 jobs, so that I was there for them going to school and on their return, I have 47 years of contributions, I have severe anxiety and depression and was declared unfit for work by my GP, I received Employment and Support Allowance for a couple of years until I had a DWP medical assessment by someone who had no connection whatsoever with mental health issues, she decided although I was deemed unfit for work I did not qualify for any financial help but would be classed as being in the ‘work related activity group’ and I could continue to receive NI credits which I don’t need because I reached the qualifying number years ago.
      I’m worn out physically and mentally, I’m living off a small Civil Service Pension of £162 a month and my husbands low paid earnings, we did a weekly shop today and were left with £1-99 until next Thursday. I feel obliged to help with child care for 3 of my grandchildren 2 days a week because their parents are struggling financially too, Christmas is going to very bleak this year because my dream of enjoying my retirement at 60 was shattered, the dream is now a total nightmare!

This has had a huge impact on my mental and physical health since last year when I turned 60 not having received any notification that I wasn’t to get my state pension! I am angry everyday and attended the rally on 10/10/2018! We should have NEVER been treated in this way!!!

We have to remember, that great to get compensation back to 60 ( I mean WOW !) by the successful conclusion of the Judicial Review, and we might get paid out monthly state pension if we have not yet retired, aged between 60 and 66 from then onwards. But the small print of the flat rate means most women will not get the full flat rate new state pension monthly money, even if you have the full 35 years National Insurance record, and might even get less than the elderly were left behind on, lesser state pension money. That is the battle to be fought via the Grey Swans into the next Labour government by us 1950s ladies retired after 2016, as well as the 1960s born about to start turning 60. Seeking Labour supporting WASPI ladies to also be members of Grey Swans, as Grey Swans is the only pension campaign group campaigning into the next Labour government, not the negotiation points into this Tory government in charge of UK parliament now.   27. Brilliant news let’s hope we get a fair hearing I never got a letter advising of the changes I have paid into the system for 44 years working from the age of 16 I’m now 61 still working . I recently checked my Government Gateway and realised the goalposts has been moved even further not only having to wait till I’m 66 to receive my state pension but 2016-2017 they changed the amount of years you have to pay in for who was informed of this I certainly wasn’t and neither was my husband. He got made redundant at 60 so took early retirement rang DWP do I have enough stamps for a full pension yes worked 45 years you will receive a full state pension at 66 checked last month he needs to pay until he is 66 to receive a full one now he was never told of this we have paid into a pension scheme for 40+ years it is a pension not a benefit we are not taking anything from the system which we have not paid for. We have been lucky to have never had to use the welfare system but with our taxes and national insurance over the years we have helped the people who have needed it ( maybe quite a lot who haven’t just a way of life ) all we are now asking is the 50’s Ladies is our pensions we have worked enough let the younger generation take our place in the workplace. Thank you to the people who have worked so hard to let our voices be heard .

Just fabulous thanks so much hope we can get some JUSTICE we have been treated shamefully swept away as if we mean nothing the forgotten people of this country we work hard paid in for years i paid NI for 49 years i have had 18 part time jobs to bring up my kids and looked after my ageing parents. Plus for 14 years my mother had vascular dementia and lived till she was 93 years old i struggled to work part time plus look after her too never claimed a penny from the state in all my life still working to make up pension short fall i received my pension ladt nov 2017 at 64 and 3 months old so where the government get 18 months wait i dont know dont the know woman are at their wits end trying to survive each week terrible what the government have got away with please help all.. thats so so much ❤

  35. Many women planned their retirement and their whole future in the understanding that the pension would be paid at aged 60. For this to be taken away from them has left them in limbo. Being forced to work a further 6 years beyond what was recognised as the proper age me and that lives have been put on hold, scraping by on basic incomes and enforced poverty. I was forced to stop work at age 54 due to illness. I thought that I would receive my entitled pension in 6 years. No, 12 years to give me a decent standard of living when I have a life-limiting illness.

  37. Thank you David in helping to fight the injustices that 1950’s born women have suffered in respect of the loss of their expected state pension at 60, without notice, some of us losing £50,000 from a pension pot we’ve paid into.

    Raising SPA for women is NOT gender equality … it is discrimination, leaving 3.8 million women without the weekly income they expected and planned for throughout their working lives. The only right and fair outcome of this government “STING” is to fully compensate all women deprived of up to six years pension and reinstate retirement at 60.

    Money from th NI fund has been misappropriated by the treasury and repeated governments, that is why they are raising the pension ages! I expect this will all come to light during the hearing.

  38. The goverment have not thought this through. The caring for elderly parents is on hold now which puts a further strain on social care not to mention the NHS. And the main carers are yes….. the women who you are forcing to work on. To say that we are living longer is also not true especially up here in Scotland which falls way behind the average age limit. It’s easy targets that you are punishing the Sick, poor, disabled. Ah well Karma will resurface and come back to bite you.

  40. Thanks for this news, a glimmer of hope for all those who are suffering this injustice. I really hope they see the devistating consequences that it has caused so many and correct this wrongdoing.
    Living on the breadline of universal credit now aged 64 and divorced. Two operations led me to give up my job. Now can’t get anything so feel on the scrap heap. Two more years to survive before I get what was promised at 60! Simply wishing one’s life away. Feel robbed of my future even though I have worked since the age of 16.
    Disgusting way So many have been treated. 😥 We must stand and fight our corner.

    • I know what you mean by wishing your life away. I’m April 55 born, part of the worst effected group and it’s all been said above. But I’m regrettably pessimistic about the outcome of this hearing. The Government have too much to lose and they will get away with it if at all possible. I hope it isn’t possible of course. This is a complex issue. Younger people do not realise how much the world has changed since the days when we started work in the late 60’s. My advice to all those effected is to get a pension forecast now if you haven’t already done so. It’s shocking how only 20% of women will qualify for the New State Pension, so I’ve heard. And don’t forget if you are short of ‘stamps’ and are looking after grandchildren, you may be able to claim NI credits now even if you are not officially working.

  42. I welcome this review. I am one of those women who has paid full contributions. I have worked since the age of sixteen. We were not given the time to prepare for this.

    I have a small pension so I now only work part time. If I wasn’t in receipt of this I would struggle. But there is no fairness in this system. I am 64years old and still have to wait for my state pension. So good luck.

  43. This is a much awaited response to the injustice some have received. The injustice is a Tory party further attempt at imposing austerity. Women have been discriminated against with out the chance to make arrangement to secure a financial stability. This has led to many of us living in poverty and not having financial security after paying into their own pension fund.

  51. I am 62 (born June 56) and have been working since I was just 16 years old. By the time my State Pension is payable I will have been paying NI contributions for 50 years.   55. I’m a Carer and not working aged 62. REGISTERED partially sighted I can’t get benefits and have £65 a week to live on. I am now spending which was to be my old Age Pension from work a Private Pension if you like. Please ease share for Our Rights. I have paid in contributions since 15. Now I am suffering for the Greed of our Government. Its my money I want my money, I’m entitled to my money before I die.

  63. Thank you to everyone who is putting up this fight for us 50s ladies. This appalling injustice needs to be rectified. Having worked since the age of 15, brought up three children, and have been taking care of my disabled husband for over 20 years. I
    finally had to stop working to become his carer full time. I’m 61 so have many years to go to collect my state pension.
    Also my mum was of the working class generation who were encouraged to pay a reduced NI being told that their husbands NI would cover theirs. She like myself worked all her life, from the age of 14, during the war, brought up 3children too.
    She struggled financially, all of her life. Those last few year’s on a stupidly low pension. My mum passed away at the age of 64 from ovarian cancer, bless her.
    Successive governments have always treated working woman and men appallingly.
    Anything you can do to right this wrong and Keep going forward has my full support. Thank you again.

I think it should be returned to 60 as most women are struggling to work past the age of 60 I am 62 at the moment I have arthritis in my knees and hands suffer with fibromyalgia and migraine and still have to hold down a job and find it very hard to keep working I’m sure there is many women like me out there

    I’m 61 and had to give up my job last year to look after my partner who was diagnosed with Prosrate Cancer and then suffered damage to his lungs as a result of the Chemo.
    Before this we both worked and were fairly comfortable but now, not only do
    we have the stress of his illness and expensive hospital Car Parking bills but we are struggling to keep up with our household bills. If I had my State Pension coming in we could just get by-however we are now slipping further and further into debt and it’s a downward spiral……

    I like a lot of these ladies have worked since the age of 15 and now I’m 63 Never claimed benefits just worked. I started my working life in the textile mills as a young girl I got married had my babies. At one stage in my life I worked part time mornings in a card factory then college afternoons to train to work in a office then part time evenings in a mill. I have another 3 years to work but I know I can’t do my stressful job for another 3 years. I don’t have good health and some mornings I have to drag myself to work. My husband is 68 when we got married our plan was he would retire at 65 and I would retire 60 in the same year until governments changed the goal post and never informed me. He is still working as he says he does not want to be home whilst I am having to go to work. I wish you well in all you are doing for us. Once again many many thanks.

I need to work 6 more years now to be entitled to a full pension.I need to continue to work now the goverment has changed the goal post.once I reach 66 if anything happens to me what will the goverment do with my contributions. Successive governments have used the funds for other purposes such as enabling employers to avoid pay NI contributions etc. The government is guilty of discrimination with regards to 1950s women and indeed men by shifting the pension beyond 65.

  78. Thank you David for your hard work on behalf of us 50s women. I had my 64th birthday in August, so have almost 2 years left before I can claim my state pension. I have worked since the age of 16 full time, with one break of 15 months when I had my son. Life has been a bit tough as son has autism and it has been a struggle to keep going with going to work and also caring for my son. I am now physically and mentally exhausted and have decided to retire in March 2019, with almost another 18 months to go before I am allowed my pension that I have paid into since 16 years old. I have every hope that the judicial review finds in our favour and we can be given our pension earlier. Again thank you for everything you are doing.

  80. Hoping something will change after long campaigning. I get £200 per month private pension after leaving work aged 61 to look after my mum and have had several health problems myself. Worked since 16 years old. Will be 65 next January and get pension May 2019. Have lost over £45,000 in pension that should have been paid. Government say they can’t afford to back date but they always seem to find millions for things they want to fund. Feel sorry for women worse off than me who are on their own.

I was made redundant at 59 and have only managed to get temporary jobs via agencies…so three years in I am tired of leaving the house at 0730 each day and not getting home until after 1900. This week no pay as I have been off work ill. I would like the option to struggle on or retire…which is how it was supposed to work until 2020.

    It is even more interesting now since LLOYDS BANK have lost their case this week in the High Court after being accused of SEX DISCRIMINATION AGAINST WOMEN regarding their pensions
    because they were increasing at a lower rate than their male colleagues so the courts have ruled that the pension trustees have a duty to amend the schemes in order to equalise benefits for men
    and women. this is a Landmark decision and proves again, the financial injustice against women and their pensions..

HOPEFULLY people who have already saved the powers that be a lot in caring for ill and other loved ones can t reat them or other members a little more which also is a valuable saving for those powers that ignored bullied and neglected 50s ladies for so long.Observing the treatment of ones senior citizens in this nasty way says more about the perpetrators than the victims who were robbed and castigated some sure left to die as a result from cold for example or just to dutifully die off which everyone knows can happen with ageing – how convenient to make tiny savings when compared to astonishingly Huge payments for everything including causes that didn’t have to wait too long or Even ask.

    • Of course you have reason to feel injustice – but this is amplified greatly for women born in mid 50’s. We didn’t even have equal pay. We were not allowed to pay into a private pension; it wasn’t offered to us. And there were so many other inequalities. Things improved a little bit between the late 60’s and the late 70’s.

  104. How interesting that the ‘Climate Activists’ that caused traffic chaos at Elephant
    and castle and blocked traffic hotspots two days ago got full TV coverage and loads
    of air- time regarding it and yet when all the BACK TO 60, WASPI women, ONE VOICE,
    SHOULDER TO SHOULDER, WE PAID IN YOU PAY OUT etc stopped the traffic and caused chaos outside the Houses of Parliament on 10th October 2018 for at least
    one hour it appears the media had been gagged and prevented from reporting it.

    • Interesting point about the climate change demos and the #50swomen blocking Parliament. But in fact the initial demo by the climate change protesters blocked 5 bridges last Saturday was completely ignored by the media as well. The TV news later that night covered riots in France and Athens but nothing about the London demos. It was only when the Observer reported the next day that there had been 85 arrests that it made the media.
      The problem is sadly that there aren’t enough journos around to report what is happening in the world – and demos often get ignored along with a lot of other things.

I am so appalled at the government for refusing to engage and the trite remarks made by over paid MPs who appear to inhabit a different world to me. My story is the same as the other ladies affected and the younger generation are with us on this, they know that the workplace was the domain of the male. Things are changing but in 1971 when I started work it was so different. No pension scheme for me and a sexist environment.   105. I was retired early due to ill health due to being assaulted at work. I have a small retirement pension, but had my incapacity benefit stopped and had not got the strength to fight the system to try and get it back. I m not 65 til Sep2020 and don’t know when I will get mine. Thank goodness for a supportive husband getting both private and state pension. We manage but capital is reducing. rapidly. We always planned for me receiving my state pension at 60. It has left a huge financial loss. Good luck with hearing.

Born in 54 started work at 15 …Paid national insurance and my taxes..How is the government treating people fairly and as equals when they just changed the rules without informing us..Research is showing we are not all living longer now it’s come to a standstill because. of austerity.Now like a lot of others I’m not in good health.My savings have gone and have to wait till 2020 when I will be a few weeks of 66!So now no peace of mind financially in my years left..

I paid into NI since the age of 17 brought up a family, began a career in my mid thirties and was made redundant age 60. Have I been able to get a job? I am one of the females who had there pention go from 60 to 66 I’m 64 yes old 65 in November since may 2016 I have had cancer twice just finished second time round of a new treatment sabre radiotherapy for my lymph node cancer I only get ESA which is sickness benefit of£126 if I had been pention age I would of got a lot more help and my pention would be more money to live on
