50s Women to apply directly to Supreme Court to ask them to hear pensions case

Lawyers for Backto60 and the two complainants decided today to apply to the Supreme Court for permission to bring their case to the highest court in the UK.

The decision was taken after two of the Judges in the Court of Appeal, who heard their case,  Lord Justice Sir Nicholas Underhill and Lady Justice Dame Vivien Rose, refused permission for them to go to the Supreme Court.

Applicants are allowed to go to the Supreme Court directly to plead their case to be heard if they are turned down by the Court of Appeal.

The decision was announced by Joanne Welch, the founder of Back to 60, appropriately during an interview with the BBC radio programme Woman’s Hour.

The decision comes after the Court of Appeal comprehensively rejected their case in a judgement announced on Tuesday. The judges ruled that the first judge , Ms Justice Lang, should not have allowed the judicial review to go ahead because it was a long time after the 1995 Act raising the pension age for women was passed. They agreed with the arguments put forward by Sir James Eadie, the Treasury Counsel, on behalf of the Department for Work and Pensions that they had been adequately consulted about the rise in the pension age from 60 to 65 announced in 1995 and later extended to 66 under the Pensions Act in 2011.

Some 3.8 million women were affected by the change which Michael Mansfield, Henrietta Hill and Adam Straw, argued amounted to both direct and indirect age and sex discrimination and had led to women born in the 1950s being driven into poverty and ill health. This was rejected by the judge, chaired by Sir Terence Etherton, Master of the Rolls.

Joanne Welch told Woman’s Hour “I know that Julie Delve and Karen Glynn have been actively considering next steps. I believe that they are going to go ahead with an application for permission to have this heard in the Supreme Court”.

Plans to ask the Supreme Court to hear the case are now being drawn up by the legal team after Joanne Welch confirmed that the decision was taken at a meeting today.

  1. Thank you for your reporting David. Discrimination was not accepted I know but surely the facts that the changes were not phased in fairly is an issue. Had I been a man born in 1955 I would have had 1 year added to my pension. As a woman I have had 6 years because I am in the catchup phase. No government would have dared add 6 years all at once as a delay for men!

    • As a Woman born in 1952 I am on the basic Lower Rate SP £135 a week
      If I were a Man born in 1952 I would be on the Higher Rate Full SP
      £175 a week
      So a Man of the same age will always be receiving the Higher Rate Pension and everytime there is a percentage rise in the pensions the Man will be even more better off !

    • Great news. Was devastated by Tuesdays judgement. Born in 1958, worked since I was 18 and took redundancy two years ago. Been living off redundancy payment since but it’s all but gone now. Considering claiming benefits now as I’m sure others are. Would rather not go down that route. Surely we will get what we paid for this time round. Third time lucky?

  2. this is good news we need to fight on it would be daft to give up now we have come thus far. I will contribute gladly if it helps win our case. a bit worried in case they do like the other judges have done and not take us seriously enough to Judge us fairly and take the DWP route again.     How can they condemn the human rights record of other countries, you don’t need to physically harm or put a gun to someone’s head to suppress a person, they are no different than any other foreign dictatorship as they have mentally tortured, demoralised and stripped bare a group of individuals who have throughout history been suppressed by their governments because of their gender. We, all groups should unite together, rise up and stand for what is right ……it’s time, they will hear us. Count me in.

    • Pay off the national debt and get the bankers out of trouble. The financial cost of full restitution should not enter into it. We paid in, so they should pay out, regardless of cost. After all, they seem to find plenty of money for everything else.

  5. I was 61 on the 15 sep .i was made redundant last November after 45 years working care .i am no looking after my sick mother and cant even get carers allowance i have no home of my own, no car . Absolutely fed up and couldnt believe the outcome on tues .like to thank the two ladies who are fighting are cause much appreciated

  6. If this fails, is there the possibility of taking it to the European courts ? if so this will have to be done quickly, before the UK actually leaves the EU….Perhaps it would be as well to prepare for this now, to do so asap !

    • We have already left the European Union, we are now in a Transitional Period to tie up loose ends.
      It’s thanks to those two stupid women who went to the European Court of Human rights in the 80s to not be compelled to retire at 60 that we are in this sorry mess now.
      We have no longer any right of redress in the European Court of Human Rights.

Let’s hope any fundraising has more clarity on how it’s spent and by who, that acknowledgement is given to the many other women and groups outside of backto60 who have contributed substantially already. That we have clarity on what the ask is and it’s transparent,…and reasonable, not just an apology.

    • The Parliamentary and Health Service Ombudsman (PHSO) will never find any ‘maladministration’ in the Waspi Cases. To get the truth about how the PHSO works, it is worth reading the book ‘What’s the Point of the Ombudsman’ by Reynolds and the PHSO Pressure Group. It has a small section on the Waspi complaints and although it includes NHS cases, it makes very clear the systems used by the PHSO. Remember that PHSO is funded and works to support the Government – it won’t ever bite the hand that feeds it. It is questionable why certain lawyers ever recommended this route when it is common knowledge how bad it is and how incredibly low the success rate is. PHSO is not a legal system unlike the Courts, despite it’s glossy website that may make people believe it is a ‘justice system’. If you cannot afford the book, at least read the recommendations below it on Amazon.

  9. Surely it was theft? A contract was broken unilaterally and money owed , by virtue of us all paying in in good faith, was taken out and never replaced. Theft is the word that should be being used and nobody, not our gov, should be above the law.

    • Thank you B Smith – I have all along thought I had made a contract with the government, in fact the contract is compounded by having a number called a National Insurance Number. This contract legally required me to pay not only NI but Income Tax whilst I worked. Like an employers pension now, the NI money was invested on our behalf and was to pay towards our pensions and NHS. I believe as a previous employer myself that eventually the two parties were merged into HMRC and in all but name are one and the same and the NI tax no longer invests for people’s pensions but is in fact used immediately the same as income tax for ‘running the country’ or basically all in one spending pot. Even so, my contractual agreement was that my pension provider would invest my money ready for me to receive at 60 years of age. Like a private pension we should have a choice of receiving it at what is now termed early ie: like our own past and present Civil Servants at say 60 years ( though they can get theirs from 55yrs) at a lower rate than if we waited until 66 yrs.

      Furthermore, I understand to get my pension I ‘only’ need 35 qualifying years, so for eg: starting work paying NI at 20yrs old + 35 yrs = 55yrs………. One problem is HMRC have no records of any contributions of any kind pre 1978 so those qualifying years cannot be counted – I have been told this first hand by HMRC.

  11. I’m not happy that fear of action by other groups with grievances against the government was a reason for rejecting the claim. If Master of the Rolls wanted to be more patronising it would have been difficult. Is the Supreme Court able to study the deliberate underhand withholding of information contained in the secret memos and if they find that the government were dishonest can they overturn primary legislation?

    To put record straight I was widowed in 2003 age 49.
    When all financial papers were sorted and my plan was put in front of me. I was told that when I reached 60 I would be getting my state pension.
    In fact I am now 66 14th Sept. Just ‘entitled’ this week.
    At no time did I receive change of years.
    So onward and upward ladies.

When the article of the other day said the finds where clear they never informed everybody only a select few. We where not informed and we require a compensation based on the facts.

  15. I am confused as to what happend about the men being able to have their contributions paid and woman have done without, surely that is discrimination or maybe favouritism towards men same thing I suppose.

    Where is all the support from the MPs who were supportive before the election. Its right what the news said, if a different party got in it would have been a different story. This tory government frustrate the life out of me but they were voted in (not by me). So maybe those of you who did vote for them were naive in thinking they would would be beaten down.

    I think its selfish of these judges to say no to an appeal on the grounds it is too long since it was passed in 1995, lets face it I am sure the 3.5million woman like me were busy working there backsides off as well as bringing up a family, whilst supporting there husband/ partner whilst. he was building his pension pot. For those who were divorced having to start again building your own pension when it was too late.

    I feel cheated and discriminated against. As for maladministration, throughout this battle, the government have maintained they did it right, I know I wasn’t informed until 2 years before 60th birthday I am now 65 but the man keeps on telling the Judges there was adequate notifications so maybe 3.5 million of us are telling fibs. LOL

As 50s women we all stand to gain from this BackTo60 initiative through the courts, they have mandate to speak for us all & get us back our paid dues. I will gladly give to a crowdfunder & have no concerns. I was 37 in 1995 & knew nothing of the changes that were being made about my state pension. I want FULL RESTITUTION….it’s my money that has been stolen. Good Luck everyone , I look forward to the new campaign!

    My own personal circumstances are that I am constantly worried about money even though I have over 41 years of national insurance contributions I still have another 4 years to wait
    Scandalous all those years of working and not receiving a letter either about the change in pension.
    I only found out by chance of new rules when I was made redundant at 58
    Couldn’t get another job despite applying for over 100 jobs!!!

  20. This is the biggest injustice l will of worked over 50 years inc NHS by the time l receive state pension like many women . Am so emotional and tired of this battle. Just feel the stress is reducing my life expectancy. Probably will never see it anyway what’s stopping government raising this again for us . Plus the risks with this pandemic for over 60s and having to work . If we had our SP would be able to retire and keep safe. There is no way we were informed officially at any stage. I’ve kept up to date with politics Absolute insult to 50s women and the deception of our monies paid in!!

  22. We will not give up and we will not be silenced, we all paid our full national insurance “stamp” most from the age of 16 years, this was a promise that we would at the age of 60 be able retire with our pensions.
    There are 3.8 million of us and this incredible injustice will not stop with us 50’s women. It’s us now, and if the govt get away with this it will be YOU next. We’re not feeble little old ladies who will quietly fade into the background, many of us have degrees and many more are unwell or tired – we want to hand over to the younger generation but can not afford to.

Why should dwp, gov, and the men win, where would the men be without women producing the future generations to come, the breeding would have stopped. If the male judges wives were in this age bracket I’m sure they would be shouting from the hilltops for justice. They don’t give a shit with the salaries they get they would not know how to live on the bare minimum wage or on uc,. Please could more cases be put forward and not just 2. Surely someone will see the absolute travesty borne by 50s women when 9.8 million men up to 2018 had NI payments made by so they could retire early. Unbelievable!! Plus previous governments since Thatchers time had stopped paying their part of the deal into the NI pot. That’s where it all went wrong without the added problem if 50s women not being allowed to pay into a private scheme especially if they were part time which most of us were because of child care. No help in those times:(

  26. My poor mother started working at 13 as her mum couldn’t afford to keep her at school. She emigrated to the UK around 28. She’s now almost 63. She was meant to retire 3 years ago and has 3 years to go. Her health has kept declining. She’s had 4 surgeries in 3 years. She was absolutely healthy at 60. By the time she can retire she’s not going to be in good health or will be forced to retire through bad health. It’s really unfair this has happened to many women. We must keep up the fight.

I fully agree with taking this to the supreme court, I am 1956 and in 2009 I was having a meeting with my financial advisor to discuss the steps to take regarding my private pension as it was nearing my 60th birthday. The only reason I had this small pension pot was because of Margaret Thatcher changing the rules so everyone had a chance and I was lucky to be able to afford it. We actually discussed the SPA and even he did not know what was happening and suggested I ring and ask, when I did ring DWP / Pension Service in 2009 they told me it was still 60 and when I said we were hearing it was 65, I was told the new law had not been enacted. How on earth could we know with such conflicting information. I finally got a letter in 2013 telling me it was 66, I’m still waiting for the first letter to inform me of the rise to 65!

  33. Just discovered on Ministry of Justice website, open to all to read the massive salaries the Judges earn.
    Master of the Rolls, Etherington £234,184 pa
    Underhill and Rose £215,094 each pa.
    Etherington retires next year, I wonder want his Pension will be, plus any possible golden handshake!
    They’re all paid by the Ministry of Justice (Government). I’m happy that Back to 60 are attempting to push our cash to the Supreme Court, but even happier that the UN are investigating the UK Gov, under the CEDAW convention. Just listened to Video of Joanne and apparently only the 4th time in 20yrs UN has done this. Start worrying BoJo!!

  36. No doubt the DWP made up their so called evidence in saying they informed us ladies. No proof whatsoever and the Government needs to justify to us ladies where did our contributions go. The DWP informed the government of the shortfall and that’s why they hitched our retirement up from 60 to 62 then to 65 and now to 66!
    Also men get one years change we ladies get 6……discrimation you decide !!
    Credits for men’s pensions to make up their contributions but non for women.
    Shambles through and through and the government know it will cost too much to give us our missing contributions. 55 years I will have contributed to this country and 30 years is all you need for the new pension……interesting how much extra I get on top of the basic pension I get.   37. This beggars believe that our government had no problem in hiding information . Net alone failing to accept that women were treated differently . Being one of these women .The 1950s backto60 group of more than 3.8 million women like me forced to work 6 more years to 1966. The government never offered to pay my National Insurance for my extra 6years. As they did for men from 60 to 65 … 3.8 million women should have had our National Insurance paid for by this government for 6 extra years . This is not equality for both women and men . Will I get a refund of my national insurance and be treated fairly .

How is it that the younger People who now have and will , retire after April 2016 only need 10 years contributions to claim the full Higher State pension at the moment £175 a week , while Women of the early 50s had to work hard to get 34 + years , to be able to claim full Old Rate SP at £135 a week …. instead of the Newer rate of £175 a week because they retired just before April 2016 and were not a couple of months younger ! Grhhh makes my blood boil !

  41. Thank you Julie and Karen, Back to 60 , the legal team and you David for supporting us. Following the court decision I, felt pretty worthless and not a little patronised. Then I watched PMQs. SNP MP Martyn Day asked Boris Johnson what he was going to do for the 1950’s ladies following the loss of our appeal. BJ replied “I will have to study the decision and will write to you”. No mention of writing to us but then, we probably wouldn’t read it anyway! I’m fuming now, so let’s keep going ladies, we can’t let anyone brush us off like that!

    • In response to Tricia’s comment. Have I missed something or has SNP MP Martyn Day been a lone voice in Parliament asking the Prime Minister what he intends to do about we 1950’s Women. I wasn’t exactly inspired by Johnsons response, especially since he has already failed to keep true to intention to look at our issues with ‘fresh eyes and vigour’. I hope Mr Day will press Johnson for the reply ‘in writing’ he should be receiving in due course. Where are all the other MPs that claim they support us and why haven’t they raised our issues in Parliament. Seemed very keen whilst the Election was going on and all now seem to have disappeared. Funny that!!!

  45. I based my Divorce settlement on the fact I thought I would receive my Pension at 60 Years of age and did not ask for part of my Ex’s Service Pension after spending 33 Years as an RAF wife. I now have no private pension and had to wait 5 Years and 5 months extra t receive my State Pension.

I heard 18 months before my 60th birthday of the first age increase and later it being 66. Still so many 50’s women not aware of the BACKTO60 group.

  47. With all due respect, I think that some important information has been left out.
    ie that the DWP/ Government had not announced nor notified women concerned of the changes. I , for one, had regularly checked my pension age date and it stayed at 60 until 2014. My birthyear is 1958.
    No chance to change tracks and enhance career especially working in the NHS.
    It only changed from 65 to 66 in April 2020.
    So , what’s their game?
    I’m appalled at the judges decision and quite frankly, the note they made concerning their fear that a triumph for Backto60 would cause others to appeal.

  49. Good Luck! At the appeal where was the evidence that the ladies HAD been fully consulted??? There are STILL women who do not know that they will retire at 67/8 yrs of age!! Too late 😵 that Is due to DWP delaying the millions of complaints of Maladministration. The DWP wrote and informed us that our complaint would be delayed due to the JR Appeal. This is NOT Justice!!

  50. A whole generation of women affected…for each one of us, its all our female school mates from primary, junior, secondary and college and uni…sisters and friends. We can’t help each other as we are all affected…3-4 years older or younger…
    Any occupational pension possibly taken from age 50 onwards (there was no communication even as late as 2011) however small is deducted from any job seekers allowance leaving little or nothing. Unless there is a male partner or other family women are far worse off than people transfering to universal credit…its a wait with litte money for 6 years.

  51. It would appear from an article I have just read in the Financial Times that this Government appears to have ‘gone rogue’! The House of Lords and The Courts do what they can but given the result we had last Tuesday I fail to see when or how things will change. Especially as The Courts are basically Government employees paid by the Ministry of Justice. After reading the article it now becomes a little clearer that our so called ‘silent’ MP supporters have been nowhere to be seen. For the oldest Democracy in the world it is unbelievable that Johnsons Government ignores and disregards the Lower House and introduces Laws with no consultation or debate whatsoever. This is what happens when the Country has such a PM as Johnson with a huge majority. This is the man who would like to style himself as the new Churchill. No way mate, you’ll never manage it!! We can only hope that Back to 60 soldier on as they have been doing on our behalf and that in the meantime MP’s, The Courts etc start to really stand up and be counted to put an end to our misery and injustice. The Country is in a terrible mess with so many things that Back to 60 really needs to remain prominent so we aren’t pushed back to become ‘invisible’ and something that has now been ‘dealt with’. In my opinion that is exactly, I believe, what Johnson thinks The Courts did for him on Tuesday.

    • Careful what you wish for. If they gave me back what I paid in it would last 3 years maximum. Many women relied on nic credits to make up their years so have paid in very little. I hope to get out a heck of a lot more than I ever paid in

Ladies you have my full support ,I myself have to work untill I’m 66 the job I do is very heavy as a carer I have to be fit and healthy I am now 65 and not as fit as I use to be and have slowed down which the younger ones complained about does this action affect ladies in Scotland as well good luck

  54. I am 63 and work for HMRC. Every day I am pushed out of my comfort zone and made to do a jiob that fills me with anxiety. It is affecting my family life and health. I was not told of rise in pension. I worked every day through lockdown, in the office. While people were receiving money for being at home, and still are. They will probably take money from my hard earned pension to help repay the countries debts. They are now bleating on about lack of employment for the younger ones. Well give me some of the £48000 they’ve stolen from me, and give my job to the youngsters now. IT really isn’t rocket science guys 😡

    • The JR was never about getting any money back. It was asking for an apology so even if it had been successful you wouldn’t have been any richer

      • no we don’t. It was a means to getting an injustice resolved – by arguing that it was discriminatory – it opened the way to a remedy. Before the appeal hearing you will find I wrote that the one thing the judges wouldn’t do is order full compensation for everybody because of the nature of what a judicial review is. Frankly the jr would have been the only way to get this government to hand back any money to the 50swomen – the pensions minister doesn’t think they should get a penny in compensation let alone full restitution.

      • I will have to disagree. Even thought BT60 were telling women the JR was for “full restitution” it clearly wasn’t. It was about an apology. BT60 may have hoped that an apology woukd lead to something more but there was no reason why it would have. Many women believed they had a chance of a big fat cheque, which was unfortunate, but at least they now know “full restitution” was always a pipe dream

I was born in 1959, little did I know that I was going to find myself at 61, living alone, divorced,living in a flat after my divorce, watching the pennies every month and with the prospect of working another 5 years in the NHS as a nurse. A job I love but which means Im exhausted and take to my bed at 9pm most week nights as even though Im fit for my age its exhausting.
    Is this fair, I would have had my state pension now and could have cut my hours.
    I feel very cheated by the government and feel that we were just given this raw deal behind the scenes with no say whatsoever.
    So well done to the Backto60 campaign , Id love to think you can win this but sadly, to the government we are only women.

  58. Another pension blunder that came to light is to be resolved soon when married women who have not been receiving the right amount of pension are very rightly going to be compensated with a lump sum and a increase in their pension.
    Here is hoping this will help us 50s women to also get some compensation and earlier retirement for us all soon too.
    We were already physically mentally and emotionally suffering enough before Covid came and we are now at increased risk in so many ways, I hope and pray we all survive and the Supreme court will help us get the justice we deserve and future retirees are treated with the compassion, respect and dignity deserved.
    I hope we get more high profile men and women and MPs on our side to increase public awareness seen as we cannot take to the streets in mass proportion at present without breaking the law so the more we get news coverage the better .

    Women have always been discriminated against, having to juggle working, looking after their family and caring for elderly parents and Grandchildren without any help.
    We are not Super women, we are just Women that needed to retire as we are struggling to cope with it all, after having our Pensions moved to 6 years without informing us

    This is theiving from our future we are every good as men .I worked even when i had babies went back when kids after few weeks
    So you come and tell us why are we classes as lower people not fit for decancy and .who do you think you are .i worked 10 hrs at times went to back part time along with work to get higher teaching assistant whilst working .You selfish .You think youre better than us well NO YOU ARE NOT AND WE SHOULD BE TREATED THAT WAY @O WILST HAVING KIDS CLEANING COOKING WASHING OH AND DECORATE IN MY HOUSE .(I DONT SEE YOU LAZY SODS GETTING OF YOUR BACKSIDES .??????????????

All working and have had worked till pension should be paid .why are we treated like 2nd civilians .this is discrimination and had to be stopped .Why is a man get treated properly yet women that worked are disciminated against women .like we are lower humans disgusting in parliments eyes its like 2nd hand BUT WE ARE AS GOOD AS YOU ?????   63. I just wonder could the European Court Of Human rights be approached even though we have left. It surely is a breach those . It can not be right that a woman loses
    Her pension but for a few months or even days of her retirement.
