Parliamentary Ombudsman slips out progress report on 50s and 60s born women pensions complaint

It is commonly known in Whitehall that if want to bury bad news, choose an obscure part of your website, make a big announcement and don’t put out a press release .Yesterday I found out Sir Robert Behrens, the Parliamentary Ombudsman, has done just that.

His announcement on the progress of his four year long investigation on maladministration by the Department for Work and Pensions over notifying the women amounts to pretty much a non announcement. Partly this is because he is restricted by an Ombudsman law which urgently needs updating, Partly it is his own fault that he has made so little progress.

I suspect that he may have thought it was a good idea to make this announcement because it was clear from the recent report on the Ombudsman by the House of Commons Public Administration and Constitutional Affairs Select Committee that people are dissatisfied with his progress. There are conflicting reports that another announcement may be imminent to follow this up.

We understand that the Parliamentary & Health Service Ombudsman may make an announcement “imminently”.We expect that this will be the official result of the first stage of their investigation. This will decide whether there was maladministration when we were given inadequate notice of the changes to our State Pension Age.

There are three stages that must be completed before decisions about any compensation can be made:Stage 1: Was there maladministration?Stage 2: If so, did the maladministration lead to injustice?Stage 3: If so, what recommendations should be made to put things right? This could include compensation.It is important to remember that a positive decision on maladministration does not automatically mean that we will get compensation. It is only the first step in the process. It will have to be good if it is meant to mollify people he hasn’t done a good job. The announcement is good in explaining to people how an Ombudsman handles an inquiry and why people need to be patient but bad in hiding his own mistakes which have contributed to this delay.

The worst example of this was his decision to pause the investigation in 2017 the moment it became clear that the BackTo60 group, campaigning for the women, were going to the courts for a judicial review on behalf of the 3.8 million women who thought they had been cheated by the decision.

Belatedly yesterday he has now admitted this was false.

“We have reviewed the Court of Appeal’s judgment and it does not affect our investigation. Our investigation is looking at the issues from a different perspective to the courts,” says the announcement.

DWP lawyers argued in court that the ministry had no obligation to tell the women

The announcement suggests that – despite the DWP’s lawyers arguing in the courts that under the 1995 Act the DWP had no obligation in law to tell anyone about the change – that the failure to inform everyone affected properly could have been maladministration. The announcement admits that the first stage of the investigation on this matter is complete and they have a preliminary finding but are not allowed by law – under the 1967 Ombudsman Act – to tell any member of the public about it.

The second clue is that he talks about the second stage – which is discussing any financial remedy for maladministration. This can only happen if the first stage is proved. The advice says there were “complaints that women were given inaccurate information about the number of years of National Insurance contributions they needed to receive a full State Pension. We will be looking at this issue as part of stage two of our investigation. “

What is depressing for the women is what the Ombudsman has ruled out . He won’t investigate full restitution or the payments of ” auto credits” – up to five years of insurance contributions only for men over the age of 60. The auto credits are controversial because originally the government intended to give them to women between 2010 and 2018 when they raised the pension age.

Low compensation

The level of compensation is also likely to be low – the one example he gives is a figure of between £500 and £950. In fact the Ombudsman can order anything from an apology and no compensation to over £10,000 in the most extreme cases.

This will be a drop in the ocean for those who have lost £40,000 or more from this decision.

It looks like any compensation will be for all including women born in the 1960s as well as the 1950s.

The real scandal is how long this will take. Covid 19 has already killed a substantial number of women in this group and bad health, stress and poverty is putting many others at risk. You only have to read the comments from people on my blog to see this.

No idea when he will report

He can’t even give a ball park date when he will report. The more he delays the fewer people will get any compensation because they will be dead. Unlike other inquiries the grim reaper will keep reducing the size of the overall compensation package.

While Covid 19 has left the government with huge bills, the effect of the pandemic since it is more severe on the elderly is reducing the Treasury’s pension bill and killing off those who would have got a pension later.

I wouldn’t suggest that ministers would be so callous to welcome the huge number of deaths among the elderly, but it is certainly saving them a lot of money on pension costs.

  1. Well that seems like the final nail in the coffin, there will be nothing given to us wo en at all, yet the government can find money for anything and everything g but not give us back what we have paid into all our lives. The awful thing is there is nothing we can do.

  2. this as gone on over 4 years how much patience are we supposed to need. we are being sold down the river once again. there is concrete evidence of discrimination as well as maladministration and because its against women they don’t give a s##t no man would ever have been treated like we have the gov would never have got away with it. they would have been hell to pay and yet this inequality goes on and on and on….. well my 6 year punishment for doing what I was told to do for 47 years solid ends later this year thank god because I can’t see this injustice ending anytime soon as the supreme court isn’t in any rush to give an appeal date either we have spent 6 months waiting for them now too. Patient! What a cheek we have been nothing else but Patient. and will keep patiently fighting on until this injustice as been put right i live in hopes but losing faith now.

  4. It’s increasingly annoying that this is dragging on. We have discussed this and the number of pensioners and pre-pensioners that have already died from Covid 19 and from other illnesses which the Pandemic has stopped treatment for. The numbers are frighteningly scary! This has undoubtedly saved the government millions of pounds both now and in the future.
    It seems that as well as being the scapegoats for saving this government millions of pounds by changing State Pension Age, women are also having to pay for the costs of Covid 19, by delaying decisions from the Ombudsman. No official Dept is independent of this government. We will not back down. Many thousands of women, including my mother, received no notification from the DWP regarding the changes in Pension age. The number of women pushed into poverty by the lack of notification is CRIMINAL. The number of women affected by this is CRIMINAL.

    • When i started work at 14,and then went on to pay my Nat ins etc, i was never told, Rosemarie, it is possible the government will have to borrow your monies during the working years until you are of pension age, would you sign this form to confirm you have been warned and that you understand what government is saying to you, as you will not get your state pension monies back from us, even tho it is your money that you have given to us.,should we ever need to do this. Now, To just take our monies all of us women have paid in towards our pension,without our knowledge, is what any person who was in a private pension or a male, would be calling this THEFT,so why is it we are not taken the government to court for theft. IF i could, and i had enough support, I WOULD . No form was ever presented to me,i was never asked, informed or requested by government, would you mind very much old chaps, or in this case, old girls,if we took your money,but not paid you back, THEFT THEFT THEFT from then young 14 years ol girls, whom now are much much older and far more sensible but utterly broke.

      • Rosemarie back to 60 took it to court twice won judicial revue and then fell on deaf ears then appealed to supreme court and they refused our appeal so deaf ears again so we are back to square one now. the deaf ears of the government!!’ Boris I need to look at the 50s womens pensions with fresh eyes and new vigour Johnson now blind as well as deaf and dosent
        know what vigour is. its ok for our gov to steal off of us and not pay our money back but if it was the other way around we would be dragged through
        the courts and locked up for defrauding them. its well overdue that this oneway street was ended and we are paid what we have been robbed of but we just don’t exist to Boris and his hanger ons…… heart breaking when we have paid in since we were 15 yrs old in my case and many others too for the best part of 50 yrs. never claimed a single benefit but hey-ho i get rewarded with 6 extra years to wait before I can claim for whats rightly mine and NOT a benefit a well paid into state pension…..

      • I agree I was looking forward to retiring next year having waited an extra 5 years only to be informed gone up again to 66 another year to wait.
        Really not fair.
        The ombudsman who is still sitting on the fact us 50 women have been badly treated and discriminated against for being women should be ashamed of himself. He knows it will cost the government if he sides with us and the low compensation amount is disgraceful. Even then that will cost alot maybe interest should be added on like ppi payments every year he’s known they were in the wrong. No forgetting this costs money.
        Why has a woman not been put in charge aswell to show fairness.More discrimination.

        Thank you for all that you are doing to help with the Womens State Pension
        I have 2 complaints to make
        Firstly I was in the first Group to be affected by the Pension age rise
        I had very little notice just before my retirement date that I was going to have to wait almost 3 years .Absolutely no time to gain extra funds to compensate
        I then find that I have been put on the old pension rate retiring just before April 6th 2016
        Secondly
        Then to find that a Man of the same age born in December 1952 who was possibly given credits has been awarded the New Higher rate post April 2016, was indeed another blow
        I was never told in advance by letter that would be the case
        This is a difference of pension of over £40 a week higher
        So I feel that I and many other Women born around the same time, have not been treated fairly .
        One more thing ,the 2.5% increase has now increased the difference of payment between the lower and higher rates .Making the lower paid Pensioners even worse off
        I thought this change was about Equality . I”m wondering why the DWP did not give the same monetary increase to everyone .

  5. Such a brave thing to NOT publish this report with publicity. It shows to me they were in the wrong in the first place. I know it’s not the present Government s fault but they are perpetuating this cover up and it’s not right!!
    We need compensating while we are well enough/ alive to enjoy it! I have 47 years NI full stamp and should have received my pension 6 years ago !!!

    May I ask where you got the information that this update was announced yesterday afternoon?

    The update that you have linked to as an “announcement” has been on their website since at least last August/September. It was certainly not yesterday.

  10. Most women in this fight support the equalisation of retirement age, although most women only retire from their paid employment, not all the other work which is on a zero salary. The unfairness comes because we were given little or no notice (in my case) that we were not getting our State Pensions at age 60, the basis our NI contributions were made. Try thinking how you would feel at age 65 or 66 (Mens retirement age) if the Government, without proper notice, suddenly said you are not getting your State Pension until you are aged 71 or 72, despite you having paid in all your working life. So before you judge our plight, try walking a mile in our shoes, who knows you might like the kitten heels and they may make you tall enough to see more clearly the injustice of what was thrust upon us.

  12. I’m so angry, sad, frustrated and many other emotions. But overwhelmingly I feel that the unfairness of these shenanigans is a deliberate act by a few men to millions of women. And the fact that there’s no hurry to rectify this is making me furious.

I would like to advise I received a letter from Pensions advising me to receive my full SP at aged 60 I would need to pay £200+ can’t remember the exact figure, as some stamps missing from when on maternity leave. I paid the amount they requested so as to receive my pension when reaching age 60. I never received any further information as to my pension not being Received and changed to age 66, not until I overheard a discussion about via two ladies. I have had a double blow, I’ve now no pension until aged 66, my husbands SP as advised last week, I’m not entitled to he was 59 and had worked 40 years
    Paying his NI but died suddenly last year , it was told to me…. unfortunately a change to Pension law means my husbands SP died with him!!! I have no home of my own, no savings, and only my single pension for myself. I really wonder who won the war because the widowed ladies, men and war widows in Germany are really very Well catered for! Financially and accommodation .

  17. You suggest that ministers would not be so callous as to welcome huge numbers of death among the elderly. Well I disagree! Actions speak louder than words! . And from what I have read the ombudsman Is drawing the process out unnecessarily. So the only conclusion one would draw from is that the government is quite happy to have deaths on their hands if it’s keeping compensation from being paid to those who are rightly due it.

    • And drawing things out for as long as possible so that, eventually, those who have not already died, have finally attained their belated retirement age and will therefore give up the fight for full restitution. Their game plan is so obvious. Is there no-one with any authority who is willing to stand up and challenge them on our behalf? Where are all the MPs who supposedly stood with us on this?   19. 50 years of paying into a pension to be told I’ll be forced to work an extra 6 years to get it is beyond words. 1950s women have been treated appalling. The younger generations should take note when you get near retirement this could and probably will happen to you because governments don’t give a toss about you. They’ll just keep taking your contributions then renege on everything they’ve said they’ll do when your due to retire. That’s what they call equality.

This is all part of an Establishment conspiracy to keep the lid on this issue until my partner and the rest of you have all got your pensions – at which point it is predicted that most protest will dissipate – or you have all died. Boris Johnson said when he came to power that there was “no magic money tree” to compensate you, despite a whole forest of money trees having seemingly since been found to deal with the effects of the Covid pandemic. It will probably be publicly recognised as a great scandal 50 years down the line, by which time it will be too late for any of you to benefit . . .

    • Absolutely agree. The name of the game as far as the Government is concerned is delay, delay and delay. It’s almost like they are playing for time. You are right, maybe in 50 years time people will look back at the plight that was suffered by 50’s women. On the other hand the talk that far in the future might be ‘do you remember when there was such a thing as the State Pension?’ .

    • That’s exactly what is happening. They will delay and delay until those affected are either dead or have finally reached their belated retirement age. If they keep stalling for long enough, there won’t be any money to pay back because, as far as the government is concerned, the problem will have sorted itself. I just can’t believe that there is nothing further we can legally do about this, but every turn is thwarted by those who have a vested interest. They never intended to give us a fair hearing. It was a stitch up from the start. Diabolical and scandalous!

  21. Another slap in the face for all women. What is the point of a parliamentary ombudsman when he can’t even do his job fully, and spends more time looking for a law that would get him out of doing his job properly.

    We need to keep up the fight for full restitution and keep bombarding them with the stories of injustice that each women has received in this country because some men in authority see them as second rate citizens. Until women fully stand up to this injustice it will continue.
    We need to show them we are no longer meek mild women who will be walked all over but women who will fight back.

  23. Why oh why is there NEVER any good news for the 50’s Women? Waspi and Back to 60 may be banging their heads against different walls, but the effect is absolutely the same. Once the initial rising of the pension age (and subsequent changes thereafter) became Law the die was caste, literally in many cases. The only redress then became challenging those decisions in other Government funded establishments. The Ombudsman for Waspi and the Courts for Back to 60, none of which, years later, seems to have moved us forward one inch.
    As for the Ombudsman suggesting that ANY compensation would be in the ballpark of £500-£1000. If Waspi have ANY decision go in their favour, these sums are derisory given how much has been stolen from us. The way it is looking I think most of the women born in the 50’s will have reached the age of 66 before any of this is resolved, so time itself will have solved the problem for the Government and for them the problem will be solved. Never mind the years of deprivation and suffering inflicted on us. But then maybe that is the very purpose of these brick walls and that is and, continues to be, the Governments intention! Just look at CEDAW, more than 40 years down the line, this still hasn’t been ratified into UK Law. Perhaps that very fact is brick wall number three.

  24. This is shambolic that somebody has the right to make a decision about us women. I am now 64 years old and have to wait another two years to get what is rightfully mine. I have always worked and had to be medically retired because of ill health. My husband who is 67 years old and has to look after me. We constantly have to worry about paying bills and trying to work out how cheaply we can live and eat. I used to live to work not work to live.

    This whole situation is disgusting that so many women have died before they get what is rightfully theirs.

    They say women don’t get a raw deal in life. I would willing to argue about that. Again a man in power has the right to say yes or no. I bet he has never had to suffer.

The callousness of the Govt taking as long as possible to have to respond, knowing all the deaths that will have ensued leaves me gasping – and there will have been more deaths in this cohort of women – in poorer economic demographic, more crowded environments and yet often living alone. We have to continue to flag up that each of these women was and is worth their state pension as originally set out by previous governments. x

  28. This is a tried and tested technique: HIV/blood products/ Haemophiliacs. They delayed as long as possible until large numbers of the people thay had infected actually died so stealing pensions from poorly-treated, underpaid women would present no problems.

I would have more respect if because of his mistake they gave our plight priority, I am fuming for all the ladies who have passed away and never received a penny of their pension, I hope if we do ever get anything their money will go to their families. I am amongst the women who have lost almost £40,000 and the promise of nothing to £950 is a joke, especial when you consider what has been spent on decorating Boris’s flat and the new Press Room, absolutely disgusting

It is all very frustrating and upsetting. Not surprising though as we don’t seem to have an adequate justice system for anything!

  31. David, thank you for continuing to support and report on this fiasco, from the bottom of my heart. Totally scandalous! Seems to me they are prolonging this debacle in an attempt to brow beat us into giving up our claim, to encourage us all to lose any hope of recovering what is rightly ours; they want us to be grateful for the insulting, meagre crumbs they want to settle on us! I for one, will support any and every action to reach the pinnacle of success by the Waspi women – at the age of 65, I am still working to support myself, despite health problems, until next year, living in rented accommodation, having divorced a husband who beat me savagely for 31years. I took nothing from the marriage because at the age of 55, I was expecting to get my full pension at the age of 60, nobody told me otherwise. I have suffered enough mental cruelty throughout my life and now the government of the day continue to torment me brutally. They are despicable! I am so disheartened for everyone because if Priti Patel has her way, we won’t even be able to protest peacefully before too long!

What makes this appalling crises is the fact they can’t see it or will not admit their terrible mistake. Let’s hope we will succeed. I have been waiting nearly 6 years for my pension I have another 10 months to go. I was born in 1956.

I know these departments are renowned for their slow pace but someone surely needs to be told that they are dragging their feet and give them a deadline to work to? This is what happens in other walks of life, be they business or personal situations, I do despair of the ineptitude of these people who are on office to serve us.

    Goalposts changed without care or consideration of the suffering that women would come to face. No wonder 50’s women feel cheated and robbed by their government’s disgraceful approach to us. Women’s Inequality continues from many angles.
    And now the Ombudsman-just thinking – don’t suppose for one minute his goal posts were ever moved out of his reach, thing is, 50’s women – if they make it – don’t give up! Bet Ombudsman Berhen took his state pension on the date he always imagined he would!

Another old man in a grey suit with a fancy title, has been able to put the ‘Kybosh’ on justice for us Women ! ……….You couldn’t make it up & with all this prevarication & lost time, this is worth of Dickens’ “Bleak House”, (Jarndice V Jarndice)…..! Looks as though this going to be an utter swindle ! HOW can they get away with compensating men differently ? It’s almost a quarter of the way through the 21st Century ! Sickening !…..   39. I’m 62, worked in some way since age of 13. Lost my husband very suddenly last September two weeks before his 60th birthday, I have received a fraction of what he was expecting from his pension and I have only just found out that I could get something from the Government. Surely the Tell Us Once service should let us know. Also my own private pensions from years ago have changed their terms. I was due a deferred pension at the age of 60 and DHL have delayed it to 66.

    I thought this change was about Equality . I”m wondering why the DWP did not give the same monetary increase to everyone .

They are purposely stringing this out in order that most women will either be dead, or will finally have qualified for their state pension 6 years late, so there will be no-one left to pay their derisory compensation to. Nice game plan! I still don’t understand how the Supreme Court could deem that our case was out of date when the first two Court cases did not.

  43. Is there nothing we can do to get a final response to our compaint. 6 years extra I have worked, now finally got pension along with a lot more life changing joint pain. I hope the younger generation take note of how we are being treated and realise that one day they too will get older and be treated the same way we have been. Unimportant, at the back of the queue behind every other cause. Silenced by death waiting on a decision from someone who let’s face it does not give a jot

  44. I am not happy this has been brought to public notice, who showed you a copy of this letter? Those of us that received these letters were told not to discuss them or show them to other people.

  45. Once again everything swept under the carpet and women get nothing that they worked for all there life paid in and then someone comes up with an idea on how to save the government money make women work longer it’s a disgrace

  46. Who gave permission for DWP to stich us women up in the first pace. The government have stolen money from all us women, if we had done this we would have been to court and probably ended up in prison but not the government who seem to change the rules as it suits. I bet not one of them are worried about their pensions, they are the ones lining their pockets at our expense.

    Surely the have to be accountable in some way?
