Coffey sneaks through tough plan to push 114,000 Universal Credit claimants into jobs while Parliament is in recess

The Department of Work and Pensions is to tighten the rules significantly to force 114,000 existing Universal Credit claimants into work as job vacancies soar across Britain.

She is changing the rules so far more people will have to go on what is known as an intensive work search regime where they will be monitored continually by work coaches on how many jobs they have applied for and why they didn’t get them.

Therese Coffey has been planning to do this since January this year and consulted the Social Security Advisory Committee, chaired by the architect of Universal Credit, Stephen Brien, on January 26.

A letter to the committee from Ian Caplan, director of employment, youth and skills said:

“The Secretary of State wishes to bring in the change as soon as practically possible…for providing immediate support to low-earning households to increase incomes at a time of immense cost of living pressures…. By bringing these regulations into force as quickly as possible, including by laying the regulations in recess, the Department can start making the operational preparations”

SSAC kept decision secret for 8 months

The committee approved the idea on February 4th but agreed to keep the decision secret until last week when it published the minutes of a meeting between DWP officials and the committee.

To make the change the government is using a regulation to uprate what is known as the Administrative Earnings Threshold – a device which sets the level of benefit and earnings dividing those who only receive ” a light touch” regime – ie occasional checks whether they are seeking work – from their local job centre and those put on intensive work search programmes. Those who refuse or don’t co-operate properly with face benefit cuts as a sanction.

It will move the level from £355 to £494 a month for a single claimant and from £567 to £782 a month for a couple. At present some 250,000 people covered by the intensive work search programme are in work – this will increase the number by 50 percent. The government justify it by saying the new level brings it into line with recent rises in the national minimum wage for those in work.

What is more interesting – and perhaps why the minutes were withheld – is the question and answer session between the committee members and civil servants.

While the overall aim of the scheme is to get a higher income for the unemployed – by getting them work or more work for those in part time jobs – the DWP admit they have another agenda. Questioned about the current job vacancies level encouraging this move officials said: “the vacancies position the labour market is considered by some to be hot which could be driving inflation.”

In other words by getting more of the unemployed into work, employers would have a bigger pool of labour and would not have to offer higher wages or even compensate people for the rising cost of living.

Will the unemployed be recruited as strikebreakers?

There may now be an even more compelling reason as Therese Coffey wants this to be law from September 26, since the government plans to use agency workers to break the coming strike wave. What would suit ministers would be if the unemployed could be drafted in as agency workers leading to confrontation with striking workers on trains, buses, schools, the NHS, and the post office with shouts of ” scab” and bringing the police in to make mass arrests of strikers. A reminder of the miners’ strike.

There were other gems from the minutes – which in my view revealed the attitudes of the DWP and committee members

There was much questioning about the effect this could have on 16-24 year olds which suggested the programme could work for them. There was concern about the disabled – and an admission by the DWP that except in Yorkshire it had done hardly any research on how this could affect them.

What was tellingly missing was the complete lack of interest from the DWP or committee members about the effects on people over the age of 50 and 60. The DWP didn’t even bother to give the committee a breakdown on them. But it is a fact that the rising of the pension age to 66 -particularly among women has seen a big increase in numbers on Universal Credit who can’t get jobs.

I really wonder whether this is prejudice. Women like Therese Coffey, who is 50, have had stellar careers and I wonder if they think women born in the 1950s and 1960s who are on the dole are failures or nonentities, don’t cause them a lot of trouble and don’t turn physically aggressive like some men. So they can be safely ignored. Certainly any thought about their plight or indeed any old person was spectacularly missing from discussion about this new drive.

Therese Coffey’s mean “pay out and grab back” scheme for the poorest elderly cheated of their rightful pensions

A new scandal was revealed in the House of Lords this afternoon which could affect tens of thousands of the poorest pensioners already cheated for decades of the right money for their pension.

The underpayments running to tens of millions – exposed by Sir Steve Webb, the former Liberal Democrat pensions minister – is slowly being sorted out by officials at the DWP though as this blog exposed earlier with the most complicated cases being delayed under a secret ” drop and go ” scheme to get the numbers up.

The minister Baroness Deborah Stedman-Scott revealed that so far £60.7 million had been paid out to 9491 people cheated of their full pension – suggesting that some of the payments must be pretty large.

Extraordinarily she could not give a gender breakdown – which led to a rebuke from Labour peer Lord Jeff Rooker who accused her of hiding the fact that vast majority must be all women.

But then came the killer blow. In answer to a question to another former pension minister, Baroness Ros Altmann, Baroness Stedman-Scott confirmed that the poorest pensioners who got the money -mostly in their 80s and 90s – would cease to get their fees paid by local councils if they got more than £23,250 in England

Hidden bonanza for care home owners

Instead they would have to pay privately until their pension savings money fell below £23,250. Given that many care homes charge differential rates for people residing there – local authority rates are often lower than private rates – this could even be a new bonanza for care home owners – as they could get more money for providing the same services.

Baroness Ros Altmann raised the issue

This “pay out and grab back” scheme was universally condemned by peers of all parties. Not one supported Baroness Stedman-Scott who was looking increasingly uneasy at having to admit this.

She hinted that in rare cases the DWP could make a special payment to a pensioner or that local authorities could perhaps waive individual fees.

“Special payments under the DWP discretionary scheme are not routinely made to those who have been underpaid state pension. However, under exceptional circumstances, such as where severe distress has been caused by the way an individual case has been handled, a case may be referred for consideration of a special payment.”

This got no purchase with the peers. The most critical comment came from Lord Forsythe of Drumlean, another former Tory minister, who accused the government of ” hiding behind the skirts of local government” rather than take national responsibility for the change.

Lord Rooker raised the issue of 50s women and the government’s ” holiday” from funding the national insurance fund

Lord Rooker linked this action to the failure to pay out the 50s women when the pension age was raised to 66.

“The noble Baroness talks about “people” and “persons”, but we are talking about women. When was the last time tens of thousands of men were short-changed with their pension? I do not recall that happening. When the Government took their long-term holiday from paying into the National Insurance Fund, they deprived hundreds of thousands of women of the pension that they were entitled to. Why cannot that be redressed?”

Government ignores answering who is to blame at the DWP

Conservative peer Baroness Patience Wheatcroft, a former journalist, wanted to know who in the DWP was responsible for this failure to pay so many people the right pension.

“My Lords, when more than £60 million that should have been paid has not been paid, surely somebody should be held responsible in the end for that error. In the private sector, the sum of £60 million would be taken very seriously. Can the Minister tell us, therefore, who was ultimately responsible for this failure to pay such a large sum of money?”

The minister couldn’t – she just blamed it on a computer failure.

She did promise under pressure to approach both the Treasury and Therese Coffey to see if the government could introduce regulations for councils to ignore the pension back payment. But admitted she might get short shrift from the Treasury.

All this points to another blow for the 50s born women when and if they get compensation in the future. By that time many may well need social care -only to find out that they will have to give back their payments to cover their care home costs.

Exclusive: The great DWP rip off – Not one person out of a potential 11 million has won compensation for losing thousands of pounds of extra pension

Those who follow my blog may remember I have been highlighting a horrendously complicated story of the plight of people who contracted out of SERPS but were told they would receive an index linked guaranteed minimum pension. This arrangement was scrapped when the new state pension was introduced in 2016 for anyone in the private sector – but remains for public sector workers.

This decision was never debated in Parliament or included in the Pensions White Paper and has meant the government got away with not paying out anything from a £1000 to tens of thousands of pounds over the lifetime of their pension, depending on how long they were contracted out by their employer from the old SERPS scheme. The numbers could be as high as 11 million and women would be the worst affected.

Rob Behrens Parliamentary Ombudsman

The Parliamentary Ombudsman, Robert Behrens, was asked to investigate and concluded that there had been maladministration and two people shared £1250 compensation. Unlike the row over the 50s and 60s born women who lost out by not being informed by the government over the rise in their pension age, no record exists, as far as I can find out, of the ministry repealing this provision in the 2014 Pensions Act.

In September 2019 the Ombudsman gave the ministry three months to sort out this issue. He asked the ministry to “review and report back on to us on the learning from this investigation, including action being taken to ensure that affected individuals receive appropriate communication from the DWP about their state pensions. “

The DWP ignored the Ombudsman’s request and only last August -in the middle of the summer recess – put up a fact sheet to inform people. There is no reference to the Ombudsman’s report, and the fact that people could be entitled to compensation. There is no mechanism for people to apply for the compensation and the notice was not even accompanied by a press release. The figures used to say how much people underplayed what people lost. And the Ombudsman wimped out of pressing the government to do anything.

Now this month the results of these devious ploys have been revealed in a letter to the Commons Work and Pensions Committee after Stephen Timms, its chairman, took up their cause.

Not ONE person in the UK has received any compensation and only four people have written to the Department about it. None of the four were entitled to extra money. Given the deliberately obscure way the fact sheet was constructed and the lack of a mechanism to apply for compensation – it is hardly surprising. The Department is also insisting that these people are better off- because the triple now double lock – has given them more money. But that is a universal payment and pales into insignificance when you think of thousands of pounds many of the people have lost.

I expect Therese Coffey, the Secretary of State and Guy Opperman, the pensions minister, were probably holding a joint celebratory karaoke session in their offices – as they had avoided paying out an extra penny to the people they had deprived of compensation.

The level of deception was heinous given that Chris Thompson, a reader who has enormous knowledge about GMP, had put in a freedom of information request to find out how many people had contacted the DWP to request compensation. He was told it was ” too expensive ” to give him the information. What mendacity by officials, how expensive is it to tell them that nobody got it and just four applied.

This sorry tale bodes ill for the 50swomen who are fighting for compensation for a similar pension maladministration – it is obvious that officials and ministers in this case have perfected a procedure to be as obscure as possible and not create any mechanism to claim compensation. Also they can’t rely on the Ombudsman to stick by them – in this case he wimped out and didn’t even hold the DWP to the fire to do what he asked them.

This is yet another example of a ministry that has no interest in justice and can rely on bamboozling the public and fake excuses for not replying to freedom of information requests.

UK intends to ratify new international convention outlawing violence and harassment at work

Step will strengthen rights for women and men facing bullies and workplace sexual harassment

Almost unnoticed and surprising announcement from Therese Coffey

Unless any MP objects next month the UK government will start drawing up a submission to the International Labour Organisation to ratify a new convention outlawing violence and harassment at work.

The announcement hardly noticed by anyone was made by Therese Coffey, the work and pensions secretary, in a written answer to Parliament this month. MPs were told if there were no objections within 21 days a ratification submission to the ILO will be drawn up and it will come into force a year later. This will make the UK the tenth nation in the world to ratify this convention and it is the culmination of two years of work following an initiative started under Theresa May when she was PM.

Rare case of political unity

In a rare case of unity in the present polarised world that characterises the UK, the action has all party backing. It has the support of the Westminster Tory government, the Welsh Labour government, the Scottish National and Green Government and the Democratic Unionist Party and Sinn Fein Northern Ireland government. It is supported by both the CBI and the TUC and has the strong support of many international NGOs, women’s groups, Care International and the human rights organisations like Amnesty International.

The convention took time to draw up and it is – for an exclusively work orientated convention – remarkably inclusive..

Stephen Russell, policy officer at the TUC, says the convention itself is very broad based and also through ILO procedures means the UK will have to produce reports every two years on how it is being implemented.

The convention covers “persons working irrespective of their contractual status, persons in training, including interns and apprentices, workers whose employment has been terminated, volunteers, jobseekers and job applicants, and individuals exercising the authority, duties or responsibilities of an employer.”

It is also covers not just the workplace but also work related trips, accommodation provided by employers, harassment on social media, office parties and other work related social activities and commuting from home to work.

According to the TUC and the government the UK had a big role in drawing up the scope of the convention. One of the leading figures was Amanda Brown, deputy general secretary of the National Education Union , which represents teachers. She is on the governing body of the ILO and was on the committee that drew up the scope of the convention.

Therese Coffey said that the government already has the legal framework to meet the requirements of the convention in both criminal and civil law but proposed to go further following recent consultations on sexual harassment in the workplace.

She said she would introduce ” a new proactive duty requiring employers to take steps to prevent their employees from experiencing sexual harassment and introducing explicit protections for employees from harassment by third parties, for example customers and clients.”

The issue of sexual harassment and violence against women has been highlighted lately in the police and Parliament where one former Tory MP. Charles Elphicke, was jailed for assaulting a member of his staff, The House of Lords has also introduced compulsory training for peers after some were accused of harassing women, including Parliamentary staff.

Only Fiji and Uruguay have ratified this, Namibia is next

So far internationally only two countries, Fiji and Uruguay, have ratified it. Another seven countries are in the process of ratifying it, including Greece, Italy, Namibia, Somalia, Ecuador, Argentina and Mauritius. Namibia will ratify it from December 9.

While the UK has ratified four UN conventions covering the rights of the child, eliminating all forms of discrimination against women (CEDAW), racial discrimination, and the rights of the disabled, but has not introduced all encompassing laws to implement the conventions.

When Scotland tried to implement in full the ratified UN Convention on the Rights of the Child, Boris Johnson instructed lawyers to go to the Supreme Court to block the move and succeeded. Similarly the government is not keen on implementing CEDAW in full with a Women’s Rights Bill.

Jocelynne Stutt, president and patron of CEDAW in Law, said:
” This is a step in the right direction but does not go far enough in sexual harassment cases. There is harassment of tenants by landlords, there is rampant harassment of students in education, and sexual harassment in the home. None of this is covered by the new convention and the UK has not ratified the Istanbul Convention which comprehensively covers sexual harassment and violence towards women.”

Whitehall’s rip off ministry: The DWP dodges paying compensation to millions of pensioners – and the Parliamentary Ombudsman lets it off

You may remember I wrote a long article on a decision taken by the Government to no longer provide an index linked guaranteed minimum pension to millions of pensioners when they new pension came into force. The blog is here.

Steve Webb: Ducking responsibility

And the man responsible for piloting that legislation, Liberal Democrat minister Sir Steve Webb, while publicly championing millions of women pensioners who have been underpaid by the ministry, is strangely silent about this issue which is he must be responsible.

What has happened since has taken morality and standards in Whitehall to new depths and exposed a level of deviousness and dishonesty among civil servants and cowardice in the Parliamentary Ombudsman’s Office that fittingly goes with a government headed by a serial liar.

In September 2019 the Ombudsman gave the ministry three months to sort out this issue. His proposals were quite clear. He asked the ministry to “review and report back on to us on the learning from this investigation, including action being taken to ensure that affected individuals receive appropriate communication from the DWP about their state pensions.

“ln particular, the DWP should ensure that their literature clearly and appropriately references that some individuals, who have large GMPs and reach State Pension Age in the early years of the new State Pension, may be negativity affected by the changes. The DWP should advise individuals to check their circumstances, and should provide instructions for how to do this;”

Sweet nothing happened

So what happened? Sweet nothing. The DWP ignored the deadline and then produced a factsheet which I know from correspondence the Ombudsman clearly felt did not fit the bill. But after one attempt to get this changed the Ombudsman dumped the issue and wimped out of getting the ministry to implement their recommendations.

Their press office told me: “

“We closed this case in November 2020 after working with the Department for Work and Pensions on compliance. At this point we referred the case to the Work and Pensions Select Committee, to oversee DWP’s ongoing work in this area. They will hold the Department to account on the actions it has agreed to take.

Actually the communication got lost and the committee knew nothing of this to the following April.

The DWP to cover its back claimed when challenged said:

“Working with the Ombudsman, we have now published information on gov.uk about this complex policy area and welcome anyone who wants to know how they have been affected by the policy change to contact us.

“Publishing this factsheet is the final step in the DWP meeting the requirements of the PHSO findings in relation to the way the GMP indexation policy change was communicated.”

It turns out that the Ombudsman agreed to this tardy response.

23 month delay

What finally happened was on August 12 in the middle of the Parliamentary recess, the department 23 months after being asked put out a publication notice amending its guidelines. The link is here.

I can’t imagine a more devious method about informing people and Parliament about this – in the middle of the August holiday. It is designed not to be seen.

Furthermore it does not comply with the recommendations which is why I say it is dishonest. There is no reference as you will see to the Ombudsman’s report, and the fact that people could be entitled to compensation. There is no mechanism for people to apply for the compensation and the notice was not even accompanied by a press release.

The losses are considerable for some people – about £27,000 for some women over the lifetime of their pension – but the information does not spell that out properly. Indeed all the DWP had to do was copy and paste as I have – a table from the Government’s Actuary Department ( at the bottom of this blog) which provided an ” oven ready ” guide to the losses.

Pathetic consultation using ignoramuses

A pathetic consultation process was held by the DWP – where they sought out the most ignorant people about pensions to comment- and only found seven out of 40 who agreed.. We only know this because the Commons Works and Pensions Committee published the details – the ministry itself has not published it.

There are probably millions of people who should at least get £500 in compensation but Therese Coffey, the secretary of state, is determined that nobody should know about it. It does not bode well for the 50s and 60s born women over their pensions compensation. She has already said the Labour Party should compensate the women not the taxpayer.

The new secretary of state’s voting record reveals a tranche of reactionary views likely to be offensive to gays, women, pensioners and non smokers.   She would also like millions of Europeans who live in the UK to have no right to stay here.
